The US House of Representatives is accelerating efforts to prohibit a central bank digital currency (CBDC) by embedding the ban within broader market structure legislation. The Anti-CBDC Surveillance State Act, championed by House Majority Whip Tom Emmer (R-MN), was previously approved by the House in July. Lawmakers now seek to integrate it into the Digital Asset Market Clarity Act—a cornerstone bill aimed at defining regulatory roles for the SEC and CFTC while establishing rules for digital asset trading, custody, and issuance.

Strategic legislative maneuvering involves attaching the CBDC ban to the market structure bill via an 'engrossment' process, bypassing standalone passage. This tactic aims to overcome political hurdles, as the standalone CBDC ban faced narrow margins. The revised package not only clarifies regulatory jurisdiction but also thrusts the CBDC debate into the forefront of crypto policy discussions, particularly among decentralized communities.

Parallel efforts are underway to advance the CBDC prohibition through other legislative channels, including the annual defense policy bill. The MOVE reflects growing skepticism toward government-issued digital currencies amid concerns over surveillance and financial autonomy.
